These Terms of Service ("Terms") form a binding agreement between you and MaCompaney, operated by Zoubair Alaoui in France ("we," "us," "our"). By creating an account, downloading the App, or using any MaCompaney service, you accept these Terms in full. If you do not accept these Terms, you must not use the App.
MaCompaney is a personal relationship management application that helps you remember and maintain meaningful connections with the people who matter to you. The App lets you save contacts, add personal notes, generate personalized message drafts using AI, send messages by email, receive reminders, and track your connections. The service is provided "as is" and is intended for personal, non-commercial use.
You must be at least 16 years old to use MaCompaney. If you are under the age of legal majority in your country (18 in most jurisdictions), you must have permission from a parent or legal guardian. By using the App, you confirm that you meet these eligibility requirements.
To use the App, you must create an account using Google Sign-In, Sign In with Apple, email and password, or phone authentication. You are responsible for keeping your credentials secure, all activity under your account, and notifying us at support@macompaney.app if you suspect unauthorized access. You may delete your account at any time from Settings → Account → Delete Account. Deletion is permanent.
MaCompaney offers a Free tier (limited contacts, basic features) and a Pro subscription (unlimited contacts, AI-generated messages, life events sharing, favors tracking, advanced reminders). Pro is available as a monthly subscription (€9.99/month) or annual subscription (€79.00/year) with a 7-day free trial. Subscriptions auto-renew unless cancelled at least 24 hours before renewal. Cancellation takes effect at the end of the current billing period — no prorated refunds except as required by law. Refunds are handled by Apple (reportaproblem.apple.com) or Google Play. EU users have a 14-day right of withdrawal, but by starting to use Pro features immediately upon subscribing, you expressly consent to immediate performance and acknowledge loss of withdrawal right once paid features are used (EU Directive 2011/83/EU, Art. 16(m)). We will notify you at least 30 days before any price increase.
The App uses Anthropic's Claude AI to generate message drafts based on information you provide. AI output may contain errors — you are responsible for reviewing every message before sending. Messages sent to your contacts are your communications and your responsibility. We make no representations about the quality or accuracy of AI-generated content. AI-generated content is not medical, legal, financial, or professional advice. We reserve the right to limit, modify, or discontinue AI features at any time.
When you add information about other people, you confirm you have a lawful basis to store it (for personal or household purposes this is generally permitted under GDPR Art. 2(2)(c)). You are responsible for the accuracy of what you record. You must not use the App to harass, stalk, or harm any person, send unsolicited bulk communications or spam, or impersonate another person. If a contact requests removal of their data, we will work with you to comply.
You must not use MaCompaney to violate any law or regulation, infringe third-party rights, send harmful or harassing content, send spam or unsolicited bulk emails, impersonate any person, attempt unauthorized access to our systems, reverse engineer the App, develop a competing service, use automated systems (bots, scrapers), or circumvent payment or usage limits. We may suspend or terminate your account immediately for any violation.
The App, including its source code, design, logo, name, branding, and all features, is owned by MaCompaney and protected by intellectual property law. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You retain ownership of all content you provide to the App (contacts, notes, life events, messages). You grant us a limited license to host, process, and transmit your content solely as necessary to provide the service. We do not use your content to train AI models.
The App is provided "as is" and "as available" without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate, appropriate, or fit for purpose.
To the maximum extent permitted by law, MaCompaney's total liability to you for any claim is limited to the amount you have paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages; loss of profits, revenue, data, or goodwill; service interruptions; acts of third parties (Apple, Google, Anthropic, Resend, or your contacts); damages from AI-generated content; or damages from your communications with contacts. Nothing in these Terms limits liability for gross negligence, willful misconduct, or where exclusion is prohibited by applicable law.
You agree to indemnify and hold MaCompaney harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, your violation of any third-party rights, or content you create, send, or transmit through the App.
You may terminate your account at any time by deleting it from within the App. We may suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent or abusive behavior, or as required by law. On termination, your right to use the App ends immediately. Sections on intellectual property, disclaimers, limitation of liability, and governing law survive termination.
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of the App after a material change constitutes acceptance. If you do not agree to updated Terms, you must stop using the App and may delete your account.
These Terms are governed by French law. EU consumers also benefit from mandatory consumer protection provisions in their country of residence and may bring proceedings in local courts. For EU consumers, disputes may be submitted to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. For users outside the EU, disputes will be resolved by the courts of Lyon, France, unless mandatory local law provides otherwise. Contact support@macompaney.app for out-of-court mediation details.
When you download the App from the Apple App Store, Apple's Standard EULA applies and Apple is a third-party beneficiary of these Terms. Apple is not responsible for the App or any claims relating to it. When you download from Google Play, Google Play Terms of Service apply.
These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App. If any provision is held invalid, the remaining provisions remain in effect. Failure to enforce any right does not constitute a waiver. You may not assign these Terms; we may assign them in connection with a merger or acquisition. These Terms are originally written in English — translations are for convenience only and the English version prevails.
